EASTERN PILATES
TERMS OF SERVICE
Last updated: September 25, 2026
Important Notice / Introduction
These Terms of Service (the “Terms”) govern access to and use of the Eastern Pilates digital service available through easternpilates.com, including its website, member platform, digital content, personalized plans, workouts, exercise sessions, educational materials, AI-powered features where available, and related digital functionality (collectively, the “Service”).
The Service is operated by PMC Baltic FZ-LLC, Licence No. 45001684, with its registered address at SFFO0507 Compass Building, Al Shohada Road, Al Hamra Industrial Zone-FZ, Ras Al Khaimah, United Arab Emirates (“PMC Baltic,” “Operator,” “we,” “us,” or “our”).
By creating an account, accessing or using the Service, completing a purchase, or taking another legally valid acceptance action, you agree to these Terms to the extent applicable to your use or transaction.
If you do not agree to these Terms, you must not use the Service.
1. Scope and Relationship to Other Policies
These Terms provide the general contractual framework governing use of the Service.
To the extent the same matter is addressed in more than one document, the following order applies:
- mandatory law that cannot legally be waived;
- transaction-specific terms clearly displayed and accepted at checkout or otherwise agreed for the particular purchase;
- offer-specific promotional conditions, where applicable;
- the Subscription Terms for recurring billing, renewals, cancellation mechanics, and subscription-specific commercial rules;
- the Money-Back Policy for contractual Money-Back Guarantee eligibility and refund review;
- these Terms for general contractual matters; and
- the Privacy Policy for personal-data processing.
The following policies are incorporated by reference where applicable:
- Subscription Terms: https://www.easternpilates.com/subscription
- Money-Back Policy: https://www.easternpilates.com/money-back
- Privacy Policy: https://www.easternpilates.com/privacy
- Cookie Policy: https://www.easternpilates.com/cookies
2. Operator, Seller and Transaction Participants
PMC Baltic FZ-LLC operates the Service.
The Seller, contracting party, and any Merchant of Record applicable to a particular purchase are determined by the checkout, purchase confirmation, receipt, invoice, or other transaction record for that purchase.
Where an authorized Seller, Affiliate, distributor, or Merchant of Record is identified for a specific transaction, that transaction-specific entity governs to the extent stated in the applicable transaction record.
Payment processors, gateways, acquiring partners, payment administrators, and other payment-service providers may process payments, recurring billing, authentication, fraud screening, refunds, reversals, chargebacks, or related payment support without automatically becoming the contractual Seller.
Affiliates or service providers may perform technical, support, finance, compliance, risk-management, distribution, or administrative functions without automatically becoming the contracting party for every user.
Personal-data controller roles and data-processing relationships are governed by the Privacy Policy, not by these Terms.
3. Acceptance and Electronic Contracting
You may accept these Terms by creating an account, using the Service, completing a purchase, clicking or tapping an acceptance or purchase-confirmation control, or taking another legally valid acceptance action.
Where affirmative purchase acceptance is required, it is captured through the applicable checkout or purchase flow.
Electronic signatures, clickwrap acceptance, electronic records, and electronic transaction confirmations may be used to form and evidence the agreement to the extent permitted by applicable law.
Subject to the Privacy Policy and applicable law, we may retain acceptance records, checkout records, purchase confirmations, and related transaction records for evidentiary, compliance, support, fraud-prevention, refund, and dispute purposes.
4. Eligibility, Age and Legal Capacity
You may use the Service only if you have the legal capacity required to enter into these Terms under applicable law.
If you make a purchase, you represent that you are authorized to use the payment method submitted for the transaction.
You may not use the Service where doing so is prohibited by applicable law.
5. Accounts and Security
Where the Service uses an account or member-access system, you must provide accurate and reasonably current information and maintain the confidentiality of your login credentials.
You are responsible for activity reasonably attributable to your account, subject to mandatory law.
You should notify us promptly at hello@easternpilates.com if you suspect unauthorized access to or use of your account.
We may request reasonable identity, account, or payment verification where needed for security, refunds, fraud prevention, payment disputes, or legal compliance.
We may apply reasonable protective restrictions where account compromise, fraud, or abuse is reasonably suspected, subject to applicable law.
6. Description of the Service
The Service may include digital plans, workouts, exercise sessions, educational materials, guides, recommendations, member-platform functionality, downloadable resources, personalized outputs, AI-powered features where available, and other related digital content and tools.
The Service may be accessed through websites, member platforms, browser-based applications or PWAs, email-based delivery, links, downloadable materials, and other digital delivery methods made available for the applicable product experience.
The Service is licensed for use and does not transfer ownership of software, content, algorithms, models, reports, designs, branding, trademarks, or other intellectual property.
7. Service Changes and Availability
We may add, remove, modify, replace, limit, suspend, or discontinue features, content, layouts, methods, tools, recommendations, AI models or providers, integrations, or other functionality from time to time, subject to mandatory consumer rights.
The Service may experience maintenance, downtime, security restrictions, technical interruptions, or reduced availability.
Future features, roadmap items, experimental features, and beta functionality are not guaranteed unless they are expressly made part of a binding transaction.
8. Licence to Use the Service
Subject to these Terms and any applicable paid entitlements, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, and revocable licence to access and use the Service for its intended personal, non-commercial purpose during the applicable access period.
No ownership right in the Service or its content is transferred to you.
We may use reasonable technical measures to enforce access limits, prevent unauthorized use, and protect intellectual property.
9. Acceptable Use and Prohibited Conduct
You must not use the Service in a way that is unlawful, fraudulent, deceptive, abusive, harmful, or inconsistent with these Terms.
Without limitation, you must not:
- copy, reproduce, distribute, publish, resell, rent, lease, sublicense, or commercially exploit the Service or its content except as expressly permitted;
- reverse engineer, decompile, modify, adapt, translate, or create derivative works from the Service except where such restrictions are prohibited by applicable law;
- use robots, scrapers, crawlers, bots, automation tools, or similar extraction methods except where expressly permitted;
- interfere with security, authentication, rate limits, access controls, payment systems, servers, systems, or networks connected to the Service;
- upload or introduce malware, malicious code, or other harmful material;
- impersonate another person, obtain unauthorized access to another account, or misuse a payment method;
- share, transfer, resell, or commercially exploit subscription access, member credentials, or account access;
- circumvent promotional, account, subscription, or refund restrictions through linked accounts, payment methods, identities, or other deceptive means; or
- use Service outputs for prohibited high-impact decisions where the Service is not designed or legally authorized for that purpose.
10. Intellectual Property
The Service, including its software, interfaces, quiz or personalization logic where applicable, designs, text, graphics, audio, video, content libraries, algorithms, AI configurations, reports, templates, trademarks, logos, branding, and other proprietary materials, is owned by or licensed to us and is protected by applicable intellectual-property laws.
Except for rights expressly granted under these Terms, all rights are reserved.
Nothing in these Terms gives us ownership of third-party or public-domain materials merely because they may appear in or be referenced by the Service.
If you believe material made available through the Service infringes your intellectual-property rights, you may contact hello@easternpilates.com with sufficient information for us to review the claim.
11. Feedback and Product Suggestions
If you voluntarily provide feedback, ideas, suggestions, or product-improvement proposals about the Service, we may use that feedback without an obligation to compensate you, provided that this does not transfer ownership of unrelated materials or information you submit for another purpose.
12. Payments and Subscriptions
Paid access, subscription-specific commercial terms, recurring billing, renewal, cancellation, failed-payment handling, and related subscription mechanics are governed by the transaction-specific checkout terms, purchase confirmation, and Subscription Terms.
Contractual Money-Back Guarantee eligibility, refund review, and related refund rules are governed by the Money-Back Policy and applicable law.
These Terms do not independently create a refund, cancellation, pricing, or billing entitlement that conflicts with the applicable checkout terms, Subscription Terms, or Money-Back Policy.
You remain responsible for validly accrued payment obligations incurred before the effective date of cancellation, suspension, or termination, to the extent permitted by applicable law.
13. Third-Party Services and Links
The Service may depend on or integrate with third-party hosting, payment, analytics, AI, communication, social-network, link, or other technology or service providers.
Third parties may operate under their own terms and privacy notices where they independently control the relevant service.
We do not guarantee the continuous availability, accuracy, or security of third-party services outside our reasonable control.
Where a third-party platform controls a transaction, billing, cancellation, or refund process, the applicable platform rules may govern that process without eliminating mandatory consumer rights.
14. Personalization and Generated Outputs
The Service may provide personalized plans, recommendations, assessments, guidance, or generated content based in whole or in part on information provided by you and on automated or algorithmic processing.
Personalization does not mean that every element is unique or individually created by a human professional, and users with similar inputs may receive similar or overlapping content.
The usefulness and relevance of personalized outputs may depend on the accuracy and completeness of the information you provide.
No particular personal, fitness, wellness, health, or other result is guaranteed.
15. AI Features
The Service may use AI-powered functionality, including automated calorie calculation and related personalized or automated recommendations where available.
AI-generated or AI-assisted outputs may be incomplete, inaccurate, or unsuitable for a particular circumstance. You should review the information provided and use your own judgment before relying on it for important health, nutrition, or lifestyle decisions.
AI-powered functionality does not constitute medical, nutritional, or other licensed professional advice unless such advice is expressly provided by an appropriately qualified professional.
We may change the underlying AI model, provider, methodology, or technical implementation from time to time, subject to applicable law.
16. Health, Wellness and Fitness Disclaimer
The Service is provided for informational, educational, fitness, general wellness, and self-improvement purposes. It is not medical diagnosis, medical treatment, emergency care, or a substitute for individualized professional medical advice.
Individual circumstances and results vary, and we do not guarantee any particular fitness result, weight-loss result, health improvement, transformation, or personal benefit.
You should seek advice from an appropriately qualified professional if you have medical questions or concerns about your health, physical condition, pregnancy, injury, symptoms, medications, or ability to participate safely in exercise or wellness activities.
If you believe you may be experiencing a medical emergency, seek appropriate emergency assistance rather than relying on the Service.
17. No Guaranteed Results
Experiences and outcomes vary between users. Testimonials, examples, estimates, recommendations, illustrations, or other reported results do not guarantee the same result for any particular user.
This section does not excuse a failure to provide the core Service substantially as described and does not remove mandatory remedies for defective or non-conforming digital services.
18. Suspension and Termination
We may suspend, restrict, or terminate access where reasonably necessary because of material breach, fraud, payment abuse, security risk, unlawful conduct, infringement, misuse, account compromise, or legal or operational necessity, subject to applicable law.
We may apply emergency protective suspension where reasonably necessary to protect users, payment systems, the Service, or third parties.
When access ends, the licence granted under these Terms ends to the extent applicable, except for rights or provisions that by their nature survive termination.
Suspension or termination resulting from a user's material breach does not by itself create a refund entitlement. Refund questions remain governed by the Money-Back Policy, Subscription Terms, transaction-specific terms, and mandatory law.
Provisions relating to intellectual property, accrued payment obligations, disclaimers, limitation of liability, indemnification, evidence, dispute resolution, and other provisions intended by their nature to survive will continue after termination.
19. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Service is provided on an “as is” and “as available” basis.
To the extent permitted by law, we disclaim implied warranties that may lawfully be disclaimed and do not warrant that the Service will be uninterrupted, error-free, permanently available, or suitable for every user.
We do not warrant that every content item, recommendation, workout, generated output, or other feature will be complete, accurate, current, or error-free.
Nothing in these Terms excludes or limits statutory guarantees, express promises incorporated into the applicable transaction, or consumer remedies that cannot lawfully be waived.
20. Limitation of Liability
To the maximum extent permitted by applicable law, we will not be liable for indirect, incidental, special, consequential, exemplary, or similar damages, or for loss of profits, revenue, business, goodwill, data, or opportunity, arising from or relating to the Service to the extent such loss may lawfully be excluded.
Where legally permitted, our aggregate contractual liability arising out of or relating to the Service giving rise to the claim will not exceed the total amounts actually paid by you for that Service during the twelve (12) months immediately preceding the event giving rise to the claim, or any greater minimum amount that applicable law does not permit us to reduce.
Nothing in these Terms excludes or limits liability that applicable law does not allow us to exclude or limit, including liability for fraud, intentional misconduct, personal injury, or mandatory consumer liabilities to the extent applicable.
21. Indemnification
To the extent permitted by applicable law, you agree to indemnify or reimburse PMC Baltic and its applicable affiliates, directors, officers, employees, contractors, licensors, and agents against third-party claims, liabilities, losses, damages, costs, and reasonable expenses arising from your unlawful use of the Service, infringement of third-party rights, fraud, or material breach of these Terms.
This section does not require you to indemnify us for our own negligence, statutory duties, or liabilities that cannot lawfully be shifted to a consumer.
22. Claims, Evidence and Enforcement
Subject to the Privacy Policy and applicable law, relevant account, acceptance, transaction, access, delivery, support, cancellation, communication, and payment records may be used to establish, exercise, or defend legal rights.
We may reasonably investigate suspected fraud, abuse, payment or chargeback misuse, infringement, account compromise, or violations of these Terms.
We may cooperate with payment networks, acquiring banks, payment providers, regulators, courts, law-enforcement bodies, or other competent authorities where legally required or reasonably necessary to establish, exercise, or defend legal rights.
23. Governing Law and Consumer Rights
These Terms and use of the Service are governed by the laws of the United Arab Emirates, excluding conflict-of-laws principles, because PMC Baltic FZ-LLC is established in the United Arab Emirates, subject to the rules below and any different transaction-specific contracting arrangement that lawfully applies.
This governing-law clause does not deprive a consumer of mandatory protections that apply under the law of the consumer's habitual residence where those protections cannot lawfully be waived.
Nothing in these Terms eliminates mandatory consumer forum rights that cannot lawfully be waived.
If a transaction is governed by a different authorized Seller or contracting entity and the applicable transaction-specific terms lawfully identify a different governing law, those transaction-specific terms control for that transaction to the extent permitted by applicable law.
24. Dispute Resolution and Arbitration
To the maximum extent permitted by applicable law and subject to mandatory consumer forum rights, disputes, claims, or controversies arising out of or relating to these Terms or the Service are subject to the arbitration arrangement described in this section.
Where enforceable for the relevant user and claim, arbitration will be binding and administered under the LCIA Rules.
Arbitration will be conducted on an individual basis to the extent enforceable. Class, collective, representative, and similar proceedings are excluded only to the extent permitted by applicable law.
You may opt out of this arbitration provision by emailing hello@easternpilates.com within 30 days of first accepting these Terms. The notice must include your full name and a clear statement that you are opting out of arbitration.
If a dispute is not arbitrable, or if this arbitration provision is unenforceable with respect to a particular claim or party, that dispute or claim will be resolved by the competent courts of Ras Al Khaimah, United Arab Emirates, except to the extent mandatory consumer law provides a different forum right.
Nothing in this section prevents either party from seeking interim, injunctive, or protective relief from a court of competent jurisdiction where legally available and necessary.
25. Electronic Communications and Notices
Purchase confirmations, account notices, billing or subscription notices, security notices, policy notices, and other transactional or service communications may be delivered electronically by email, account messaging, website notice, or another reasonable electronic channel, subject to applicable law.
Consent to transactional or service communications under these Terms does not by itself constitute consent to marketing communications where separate consent or opt-out rights apply.
You are responsible for keeping contact information reasonably current and should monitor the communication channels associated with your account or purchase.
Subject to applicable law, an email notice may be treated as sent when transmitted to the email address associated with your account or transaction, even if it is filtered into a spam, promotions, junk, or similar folder or is not read.
26. Changes to the Service and These Terms
We may update the Service and these Terms prospectively as features, entities, vendors, business operations, or applicable law change.
Where legally required, we will provide additional or advance notice of material changes.
A change to these Terms does not retroactively rewrite a completed transaction or remove rights that have already accrued under mandatory law.
Where affirmative consent is legally required for a material contractual change, that consent will be obtained rather than relying solely on continued use.
27. Standard Contract Clauses
Assignment. We may assign or transfer our rights and obligations under these Terms in connection with an affiliate reorganization, financing, merger, acquisition, sale, transfer of the Service, or similar business transaction, subject to applicable law. You may not assign or transfer your rights or obligations except where permitted by law or with our prior written consent.
Force Majeure. We are not responsible for delay or failure caused by events outside our reasonable control, including material failures of hosting or infrastructure providers, internet outages, cyber incidents, natural disasters, governmental actions, labour disputes, riots, war, terrorism, or major infrastructure disruptions, except to the extent mandatory law provides otherwise.
Severability. If a provision is invalid or unenforceable, it will be limited or severed to the extent legally required and the remaining provisions will continue in effect where permitted.
No Waiver. Failure to enforce a provision on one occasion does not waive the right to enforce it later.
Entire Agreement. These Terms, the incorporated policies, and applicable transaction-specific checkout terms and purchase records constitute the contractual framework governing the Service and the relevant transaction.
Headings. Headings are for convenience and do not control interpretation.
28. Language
The English version of these Terms is the original version.
If a translated or localized version differs from the English version, the English version controls to the extent permitted by applicable law. Mandatory local-language requirements remain unaffected.
